According to the Article 279.0.4 of the The Administrative Offenses Code of the Republic of Azerbaijan provides fines and punishments for failure to fulfill obligations on the efficient use of energy resources established for energy producers in accordance with Article 13 of the Law of the Republic of Azerbaijan “On Efficient Use of Energy Resources and Energy Efficiency”, taking into account the results of the assessment of energy efficiency potential.

According to paragraph 5.1 of the " The procedure and criteria for assessing the efficiency potential of electric and thermal energy generation and natural gas processing " approved by the Resolution No. 123 of the Cabinet of Ministers of the Republic of Azerbaijan dated April 18, 2023, The Ministry of Energy, taking into account the results of the assessment of the energy efficiency potential, determines obligations for the efficient use of energy resources for energy producers.

Article 3.1. Technical assessment criteria for efficiency potential include the following:

3.1.1. Production/processing volume;

3.1.2. Electric and thermal power;

3.1.3. Loss levels in produced/processed products;

3.1.4. Useful energy output (energy transmitted to the grid);

3.1.5. Useful work coefficient;

3.1.6. Specific fuel consumption for product production (amount of fuel consumed per unit of product at the output of the production facility);

3.1.7: Production of products per unit volume of gas in the natural gas processing sector.

The "State Accounting Rules for Harmful Substances Emitted into the Atmosphere and Harmful Physical Impacts", the "Rules for Issuing Special Permits for Emissions of Harmful Substances into the Atmosphere and Harmful Physical Impacts", and the "Rules on the Amount and Use of Payments for Obtaining Special Permits for Emissions of Harmful Substances into the Atmosphere and Harmful Physical Impacts" were approved by the Cabinet of Ministers of the Republic of Azerbaijan in its Decision No. 112 dated July 13, 2002
